Moreover, both Hart and Dworkin defend positions that are contructive rather than critical : their theories are paradigms of the search for an impartial legal interpretation. As such, they often constitue a necessary background to many critical theories - some equally extreme and insightfull - whose most basic project, as we shall see, is to deny such impartiality. |
