Abstrak | The basic law establishes a democratic state governed by the rule of law.like the united states,germany has a parliamentary system in which the executive is chosen and removable by the legislature; yet more care has been taken in Germany than in this country to ensure that legislative policy is determined by the legislature, that judicial business is handled by independent judges, and that administration of the laws is subject to unified executive control. There is judical review of both legislative action and executive action, but much of it takes place before a special constitutional court,which has jurisdiction not only over traditional constitutional complaints but also over an interesting arrary of invergofemental abstract proceedings unknown in the courts of the unoted states.there is an extensive catalogue of fundamental rights,which has been held to include a general freedom to do whatever one pleases. |
