Abstrak The purpose of this book is critically examine the concepts of individual right and effective judical protections in the European Community legal order, and to assess the viablitiy of their continued deployment to explan, justify and rationalise the farreaching effects of EC law in the national legal system of the EU member state. More Particulary, a comparison will be made between avenues for contesting the compatibility of national rules with Community law, and the efficacy of remedies afforded to individuals or private parties as they might otherwise be termed, anomalies and inconsistancies permeating these areas in the case law will be teased out to reveal what appears to be significant fault line in the EC constitutional structure.
