Abstrak This book was first published in 1996, and thus this edition marks its 10th anniversary. In that time, the high court has been transformed, with only Gummow J Remaining on the bench from the time of the first edition. The Court`s case mix and judicial approach has been an equivalent shift. Gone are the days when the court under Sir Anthony Mason first implied a freedom of political communication and even considered the idea of a guarantee of legal equality. Such implications are now more likely to be narrowly construed, or indeed bypassed due to the use of principles of statutory construction that enable the court to avoid the need for constitutional analysis at all.
