The Court might have held that the right did not vest until delivery of the commission, thus avoiding the constitutional issues, but the Court instead stated that an irrevocable right accrued to individual after the execution of the commission. The Court thus critized the new administration and President Jefferson, who was Marshall’ political adversary. On the second issue, the opinion found that the “essence of civil liberty” required a legal remedy for a legal wrong. Because the government of the United States is one “of laws and not of men” it must grant a remedy for violation of vested legal rights. Marshall did note that there would not be a judicial remedy for a wrong if the subject matter was political in nature of otherwise committed to the discretion of the executive.
